This document defines the principles of personal data processing by Opengater. It describes the rules for collecting, processing, storing, and protecting user information when using our internet resources, software products, and digital solutions. By continuing to use Opengater, you agree to the data processing conditions set forth in this document.
CATEGORIES OF PROCESSED DATA
Our company adheres to the principle of data minimization and processes only the information required for proper functioning of Products:
Account Data
- Contact email for registration, communication, and access recovery
- Username, nickname (if available), and ChatID
Financial Data (for commercial plans)
- Transaction amount, currency used, and transaction time
- Payer's email
Financial transaction processing is carried out by payment systems listed in the User Agreement. These organizations receive access to financial information solely for conducting transactions.
DATA PROCESSING PURPOSES
Collected data is used for:
- Managing user accounts
- Ensuring the operation, support, and improvement of Products
- Generating payment links for balance top-ups
- Processing user requests and resolving technical issues
- Sending important notifications and promotional materials
DISCLOSURE OF DATA TO THIRD PARTIES
We DO NOT sell, exchange, or otherwise transfer personal data to third-party organizations.
DATA RETENTION PERIODS
Personal data is stored exclusively for the period required for the functioning of Products and fulfillment of legal obligations:
- Financial information is retained for 10 years after the last transaction for tax accounting and financial reporting purposes.
- Marketing consent remains active for 2 years after subscription ends or until you unsubscribe from such messages.
- Support ticket data is kept for 1 year after closure, except technical device information for diagnostics (maximum 6 months).
Upon expiration of these periods, information is subject to destruction or anonymization.
TECHNICAL AND ORGANIZATIONAL SECURITY MEASURES
User data security is our priority. We apply a comprehensive set of technical, physical, and organizational measures corresponding to leading industry practices:
- Cryptographic data protection during storage and transmission
- Firewalls, access control systems, and intrusion monitoring
- Regulated personnel access and regular information security training
In the event of a security incident, we immediately inform affected users and take emergency measures to protect systems.
CROSS-BORDER DATA TRANSFER
Processing of your information may be carried out in countries other than your country of residence, including the United States and European Union countries. These jurisdictions may have different personal data protection standards.
We guarantee the application of appropriate protective mechanisms, including standard contractual clauses approved by the European Commission, to ensure your rights and freedoms. By using Opengater, you consent to cross-border data transfer in accordance with the stated conditions.
CORPORATE CHANGES
In the event of Opengater participating in merger, acquisition, or asset sale processes, personal data may be transferred to the successor organization. All obligations provided by the Privacy Policy at the time of transfer remain in effect.
POLICY CHANGES
We reserve the right to periodically make changes to the Privacy Policy to reflect changes in our processes or products. Users will be informed of significant changes via email or through notifications on our resources before the changes take effect. Continued use of Opengater after changes confirms your acceptance of the updated Policy.
